1. About These Terms

These Terms of Service ("Terms") govern your access to and use of Schooly ("the Service"), operated by Actilynk Ltd, a company registered in England and Wales (company number 12475434), with registered office at 8 Lewis Road, Swanscombe, Kent, DA10 0JH, trading as "Schooly".

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Schooly provides AI-powered exam practice and marking tools for students and educators. The Service includes:

  • Question practice and AI-powered marking with feedback
  • Progress tracking and performance analytics
  • Class management and assessment tools for teachers
  • Curriculum-aligned content across multiple exam boards

3. User Accounts

3.1 Account Creation

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3.2 Account Types

  • Student accounts are for individual learners. Users under 13 require parental or guardian consent.
  • Teacher accounts are for educators managing classes and assessments.
  • School and Department accounts are organisational accounts managed by authorised administrators.

3.3 Age Requirements

The Service is designed for users of all ages. Users under 13 must have verifiable parental consent before using the platform. We comply with the UK Age Appropriate Design Code and the Children's Online Privacy Protection Act (COPPA).

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Share account credentials with others
  • Submit content that is harmful, offensive, or infringes third-party rights
  • Use AI features to generate harmful, misleading, or academically dishonest content
  • Circumvent usage limits or access controls

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI-Generated Content

The Service uses artificial intelligence to mark answers and provide feedback. You acknowledge that:

  • AI-generated marks and feedback are for educational purposes only and do not constitute official exam results
  • AI marking may occasionally differ from human marking
  • We continuously work to improve accuracy but do not guarantee that AI marking will match any specific exam board's marking standard
  • Teachers retain the ability to review and override AI-generated marks

6. Your Content

6.1 Student Content

Answers and practice responses you submit remain your property. You grant us a licence to process this content for the purpose of providing the Service (marking, feedback, analytics).

6.2 Teacher Content

Questions, assessments, and resources you create remain your property. You grant us a licence to store and display this content to your students and within your organisation.

6.3 Content Removal

You may request deletion of your content at any time through your account settings or by contacting support.

7. Intellectual Property

All platform features, branding, and functionality are owned by Actilynk Ltd. Exam questions on the platform may be sourced from or inspired by publicly available examination materials, which remain the property of their respective exam boards.

8. Subscriptions and Payments

8.1 Free Tier

Free accounts have limited daily usage. These limits may change with reasonable notice.

8.2 Paid Plans

Paid subscriptions are billed monthly via Stripe. You may cancel at any time; access continues until the end of the current billing period.

8.3 School and Department Plans

Organisational plans are billed per seat. The account administrator is responsible for managing seats and billing.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
  • We are not liable for decisions made based on AI-generated marks or feedback

10. Data Protection

Your use of the Service is also governed by our Privacy Policy. For schools and departments, the Data Processing Addendum applies.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the version number and effective date
  • Users will be prompted to review and accept the updated terms
  • Continued use after acceptance constitutes agreement to the updated terms

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
